Lannore publishes films that creators license to us and checks their rights information before publication. If you nevertheless believe that something on Lannore infringes your rights or is unlawful, this policy explains how to tell us and what happens next. It applies to films, trailers, stills, posters, descriptions, profiles, comments and any other content on Lannore.

1. How to send a notice

1.1 Send your notice to contact@agimetis.com with the subject "Notice", or use the report function in the app. A notice should contain:

  1. your name and email address (not required if you report child sexual abuse material);
  2. the exact location of the content, preferably its link, and, if it is a film, the time code;
  3. an explanation of why you consider the content unlawful or infringing, and which right or law you rely on (for copyright: the work you hold the rights in, and your authority to act for the rights holder);
  4. a statement that you believe in good faith that the information and allegations in the notice are accurate and complete.

1.2 We confirm receipt of your notice. If a notice is unclear, we may ask you for more information before we act.

2. What happens after a notice

2.1 We review every notice carefully, objectively and without undue delay. We may make the content unavailable while we review it, in particular where an infringement is likely or where the content could cause serious harm. Doing so is not a finding that the content is unlawful.

2.2 We tell the creator or member concerned about the notice and give them the opportunity to respond, unless this would be unsafe, would prejudice an investigation or is forbidden by law. We may tell them your name and email address if this is necessary to clarify the matter, for example because they claim to hold a licence from you; if you do not want this, say so in your notice.

2.3 We decide whether to remove the content, restrict it to certain countries, restore it or take no action, and inform you and the person concerned of our decision with a statement of reasons and the available means of redress.

2.4 Both you and the person concerned can ask us to review our decision within six months under "Decisions and appeals" in the app or by email. You may also use an out-of-court dispute settlement body certified under Article 21 of the EU Digital Services Act, and you remain free to go to court.

3. Notices under United States law

3.1 If you rely on United States copyright law, you can send a notice that meets 17 U.S.C. § 512(c)(3) to the address in section 1; we handle it under this policy. We have not registered a designated agent with the U.S. Copyright Office; we will name one here before we offer Lannore commercially in the United States. Until then, sections 1 and 2 apply in full.

The notice should contain:

  1. a physical or electronic signature of the copyright owner or of a person authorised to act for them;
  2. identification of the copyrighted work claimed to be infringed;
  3. identification of the material claimed to be infringing and information reasonably sufficient to locate it, such as its link;
  4. your name, address, telephone number and email address;
  5. a statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law; and
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act for the copyright owner.

3.2 Counter-notice. If your material was removed because of a notice and you believe this was a mistake or misidentification, you can send us a counter-notice at the address in section 1 containing:

  1. your physical or electronic signature;
  2. identification of the material that was removed and where it appeared before removal;
  3. a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of a mistake or misidentification;
  4. your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located or, if your address is outside the United States, of any judicial district in which Lannore may be found, and that you will accept service of process from the person who sent the notice or their agent.

We forward the counter-notice to the person who sent the notice. Unless they tell us within 10 business days that they have filed an action seeking a court order against you, we restore the material within 10 to 14 business days after receiving the counter-notice, unless another reason in this policy or the law prevents it.

3.3 Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages.

4. Repeat infringers and misuse

4.1 We close the accounts and creator profiles of members who repeatedly infringe the rights of others or repeatedly post unlawful content, in appropriate circumstances and after a warning, and may refuse new accounts from them.

4.2 We may stop processing notices from a person who frequently submits notices that are manifestly unfounded, after a warning and for a reasonable period.

4.3 Making a false notice or counter-notice can make you liable to the person affected and to us.

5. Creators

Creators declare and are responsible for the rights in their films (Creator Terms, section 4). If a notice concerns a film, we may hold the earnings from that film until the matter is resolved (Creator Terms, section 7.5).

6. Records

We keep notices, responses, decisions and the related evidence for as long as needed to handle the matter, to respond to appeals and legal claims, and as the law requires (Privacy Policy). In an emergency, or if a person's life or safety is at risk, contact the police.
